This Terms of Service ("Agreement") governs your access to and use of the Zocia Application ("App").

Definitions

In these Terms of Service, the following terms have the meanings set forth below:

Article 1: General Provisions

1.1 Conflicting Rules

These Terms of Service (TOS) determine the main rules of use for the Application. They are supplemented by additional policies – the Privacy Policy. In the event of a conflict between the various policies making the rules inaccessible, unintelligible and/or unpredictable, these TOS shall prevail over the Privacy Policy.

1.2 Independence of Provisions

Should any provision of these TOS be declared invalid or inapplicable due to the effects of a law, regulation or ruling by a court with relevant jurisdiction, the other provisions shall remain effective and in force, unless these TOS become distorted, or the obligations of the parties significantly thrown out of balance.

Article 2: Amendments to the TOS

2.1 Updates

App reserves the right, unilaterally and at any time, to add to or amend these TOS as it sees fit or to terminate the Services. The Member will be informed of updates to the TOS via the Application and/or by email sent to the address provided by the Member. It is the Member's responsibility to ensure that this email address is valid and to carefully read the updated TOS. Complete acceptance of the changes is implied by the Member's continued use of the Application’s Services following the updates. Should the Member not agree with changes made to the TOS, he or she has the option to end the Services and delete his or her Account as per Article 13.3.

2.2 Immediate Effect

All new versions of the TOS shall be effective immediately for all Members.

Article 3: Governing Law and Dispute Resolution

3.1 Governing Law

These TOS shall be governed by French law, exclusive of its conflict of laws rules.

3.2 Dispute Resolution

In the case of dispute, the Member agrees to contact App directly in writing prior to taking any judicial or extra-judicial action. Any challenge or dispute related to the formation, interpretation, performance or expiry of these TOS which has not been amicably settled shall be submitted to the relevant courts of Paris (Hong Kong).

Article 4: Registration

4.1 Application Download Options

The Application is available for free download through Apple’s official platform. Supported devices include iPhones running iOS 10. Provided that the required conditions for Member status are met, App will assign the Member a personal Account, which includes a profile page, a private inbox, and a notifications function. Each Member may only have one Account.

4.2 Registration Methods

By registering, the Member is deemed to have read and accepted these Terms of Service and the Privacy Policy.

4.3 Eligibility and Member Obligations

Members must be at least 18 years old and are fully responsible for the legality of their registration and use of the Account. If the Member chooses to edit their profile after registration, the information provided must be accurate, truthful, and kept up to date.

Article 5: Purpose and Scope of Services

5.1 Purpose of the Service

It allows users to showcase their voice impressions, character mimicry, facial-expression performances, and creative reinterpretations of well-known figures or styles. Within the Application, Members can upload short videos, audio clips, and performance posts. Other users may freely browse public performances and updates. However, access to certain advanced features requires a paid unlock.

The Application may use intelligent recommendation mechanisms to suggest relevant Imitation Content and other Members based on individual preferences. The services provided by the App are intended solely to facilitate online expression, creative performance, and community interaction among individuals interested in imitation and performance art. They do not constitute professional acting training, talent agency services, entertainment brokerage, or any form of commercial performance management.

5.2 Services for Users

Article 6: Protection of Personal Data

App is very concerned with the protection of your personal data and the respect of your privacy. We suggest that you read our Privacy Policy and our Confidence Charter carefully.

Article 7: App's Obligations and Liability

7.1 Technical Resources and Security

App agrees to provide the infrastructure and technical resources to provide a high-quality service to Members with an iPhone device running operating system version iOS 10 or higher. App cannot be held liable for any operating fault on the Member's device or for any compatibility issue. App uses firewalls to minimize risks but cannot fully guarantee network security. App is not responsible for failures caused by the Member's internet provider.

7.2 Illegal Conduct

App and its partners cannot be held liable for actions by its Members which are illegal or which incur criminal penalties, including scams, commercial activities, prostitution, identity theft, infringement of intellectual property or personal rights. Such behavior may result in suspension or termination.

7.3 Reporting and Community Moderation System

When content is reported, the transmitter’s account can be suspended or terminated. The reported Member will not be informed of the reporter's identity. Members can also block other Members to prevent conversation. This reporting system does not replace judicial procedures.

7.4 Duty of Caution

The Member is solely liable for checking the identity of people with whom he or she wishes to arrange a real-life meet-up. App may not be held liable for any problems arising from a real-life meet-up.

7.5 Group Events

Using the Application to plan or organize a demonstration in a public place is strictly prohibited. App may not be held liable in the case of a public order offense or damage caused by such meeting.

Article 8: Member Code of Conduct

8.1 Duty of Fairness and Honesty when Registering

Members must be adults (18+), agree to update information regularly, and accept the TOS. App reserves the right to investigate suspicious accounts and may request ID proof. Multiple accounts are prohibited.

The Member agrees to use the Application solely for personal use. Commercial, promotional, electoral, or recruitment purposes are prohibited.

8.4 Member's Liability

The Member is only liable for his or her own actions. The Member shall hold App harmless against any conviction regarding the Member's infringement of the law or TOS.

8.5 Photos

All photos of a pornographic or exhibitionist nature are strictly prohibited and can lead to account termination.

8.6 Real-life Meet-ups

Members are solely responsible for verifying identities and arranging safe meetings in public places. App is not liable for acts committed during real-life meet-ups.

8.7 Account Management

The Member is solely responsible for login information and must ensure no third party accesses them.

8.8 Equipment

The cost of equipment and telecommunications costs shall be borne solely by the Member.

Article 9: Charged Services

9.1 Subscription Packages

Members may subscribe to premium services. Subscription plans provide access to premium features for the selected period. Promotional offers are restricted to one use per Apple ID.

9.2 Payment Terms

Subscription fees are charged to the Member’s Apple ID account. All payments are processed by Apple. The App does not handle refunds; requests must be submitted to Apple.

9.3 Subscription Term and Auto-Renewal

Subscriptions auto-renew by default unless disabled at least 24 hours before the end of the current period. Cancellation does not result in a refund for the current period.

9.4 Subscription Plans and Pricing

Prices vary by region. Payment is charged upon confirmation. Members may manage subscriptions via Apple ID settings.

9.5 Cancellation Rights and Refund Policy

Refund requests must be submitted directly to Apple via the “Report a Problem” page.

9.6 Early Termination

If a Member violates Terms, App may terminate the subscription without refund.

Article 10: Communication with the Member

10.1 Push Notification

Members may receive push notifications for events like receiving a SuperCrush, Messages, or App announcements. Preferences can be changed in Account settings.

Article 11: Intellectual Property

11.1 Prerogatives related to Copyright

Original works provided by App are exclusively owned by App. Reproduction or distribution without authorization is prohibited.

11.2 License

Usage rights granted to the Member are for private and personal use only. The Member grants App a free-of-charge, non-exclusive, international license to use content provided by the Member for communication purposes. The Member retains ownership of their content but holds App harmless against third-party IP claims.

Article 12: Counterfeiting, Unfair Competition and Parasitism

It is strictly prohibited to design a similar product or engage in unfair competition. Members risk legal penalties for attempting to sell or commercially exploit the Services.

Article 13: Termination

13.1 Deactivation of the Account by the Member

Deactivated profiles become invisible. Data is retained for one year for potential reactivation.

13.2 Uninstallation of the Application by the Member

Uninstalling does not delete the Account. It is recommended to delete the Account before uninstalling.

13.3 Suspension/Termination by App

App may suspend or terminate accounts for breach of TOS. Upon termination, the profile becomes invisible, and remaining virtual items are deleted without reimbursement. The Member cannot create a new account for 1 year.

13.4 Termination of Inactive Accounts

Accounts inactive for one year (no server contact and no use) may be deleted after an 8-day notice. Subscriber accounts are not considered inactive.

Article 15: Confidentiality Clause

Neither App nor the Member are authorized to disclose information about the agreement between them, and each party agrees to comply with a confidentiality clause.
